The 3M/Dupont PFAS Water Settlements represents a once-in-a-generation opportunity for Tribal governments to secure funding to address long-standing PFAS contamination in drinking water and surface water systems. PFAS—often referred to as “forever chemicals”—have disproportionately impacted Tribal communities due to legacy industrial activity, military installations, and aging water infrastructure. While Tribal water systems are eligible claimants under the settlement, the process to determine eligibility, properly document claims, and secure the full amount of funds to which a Tribe is entitled is complex and time-sensitive. Without informed engagement, Tribes risk under-claiming or missing settlement resources altogether. Strategic participation ensures that settlement proceeds are not only secured, but also translated into effective, culturally aligned remediation plans that protect public health, safeguard natural resources, and uphold Tribal sovereignty.

Without timely and focused action, significant PFAS settlement funds risk going unclaimed by Tribal governments due to rapidly approaching and inflexible deadlines. In fact, claim periods for two related settlements—Tyco and BASF—have already closed, and Tribes are no longer eligible to receive funds from those agreements. Eligibility and award amounts under the remaining settlements are determined by factors such as system water flow and measured PFAS contamination levels, as reflected in settlement allocation methodologies. Current awards have ranged from approximately $36,000 to more than $136 million per award, underscoring both the scale of opportunity and the cost of inaction. Proactive engagement is essential to protect Tribal interests, preserve eligibility, and ensure access to funds intended to support long-term water safety and environmental protection.
